Thanks for choosing SEASONFORT — where we believe the best nights are spent under the stars (in seriously good gear). These Terms & Conditions ("Terms") govern your use of our website at http://www.seasonfort.com/au and any purchases you make through it. By browsing, clicking, or buying, you're agreeing to play by these rules.

So grab a camp chair, maybe a hot drink, and have a read.

  1. WHO WE ARE

We're Safely Pty Ltd (ABN: 13 150 947 827), a company registered in Queensland, Australia, trading as SEASONFORT. We design and sell outdoor gear to adventurers in Australia and around the world.

Registered jurisdiction: Queensland, Australia.

  1. USING OUR WEBSITE

2.1 Eligibility

You must be at least 18 years of age (or the age of legal majority in your country) to make a purchase. If you're younger than that, get a parent or guardian to place the order for you — consider it a bonding exercise before the next camping trip.

2.2 Your Account

If you create an account with us, you're responsible for:

  • Keeping your login details secure (treat them like your favourite head torch — don't leave them lying around)
  • All activity that occurs under your account
  • Letting us know immediately if you suspect unauthorised access

We reserve the right to suspend or terminate any account that we reasonably believe is being misused.

2.3 Acceptable Use

When using our website, you agree not to:

  • Use it for any unlawful purpose
  • Attempt to gain unauthorised access to our systems or data
  • Introduce viruses, malware, or other harmful code
  • Scrape, data-mine, or reproduce our content without written permission
  • Interfere with the website's functionality or other users' enjoyment of it

Basically: be a good campsite neighbour.

  1. PRODUCTS & DESCRIPTIONS

3.1 Product Information

We do our best to ensure all product descriptions, images, specifications, and pricing on our website are accurate and up to date. However, we're human (and sometimes we're writing product descriptions from inside a tent), so we don't warrant that every detail is error-free.

Colours may appear differently on your screen compared to the real thing. If you have questions about a product before ordering, reach out — we're happy to help.

3.2 Availability

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or modify specifications at any time without prior notice.

  1. ORDERS & PRICING

4.1 Placing an Order

When you place an order through our website, you're making an offer to purchase. We'll send you an order confirmation email, but this doesn't mean we've accepted your order yet. Acceptance occurs when we dispatch your goods and send you a shipping confirmation.

We reserve the right to refuse or cancel any order for any reason, including but not limited to:

  • Product unavailability
  • Pricing errors
  • Suspected fraudulent activity
  • Inability to verify your identity or payment information

If we cancel your order after payment has been taken, we'll issue a full refund.

4.2 Pricing

For Australian Customers

All prices displayed for Australian customers are in Australian Dollars (AUD) and are inclusive of GST (Goods and Services Tax) where applicable. GST is charged at the prevailing rate under Australian tax law (currently 10%).

For International Customers

All prices displayed for international customers are in the applicable displayed currency and are exclusive of GST. No Australian GST is charged on orders shipped to destinations outside Australia.

Please note: International customers may be subject to import duties, taxes, or customs charges imposed by your country's authorities upon arrival of your goods. These charges are your responsibility and are not included in our pricing or shipping costs. We recommend checking with your local customs office before ordering if you're unsure.

4.3 Pricing Errors

We work hard to get our pricing right, but if we discover a genuine pricing error before dispatching your order, we'll contact you to let you know. You'll have the option to proceed at the correct price or cancel for a full refund. We are not obligated to fulfil orders at an incorrect price.

4.4 Payment

We accept payments processed securely through eWay and PayPal. All payment card details are handled by these third-party providers — we never store your card information on our servers.

Payment must be received in full before we dispatch your order. By providing payment details, you confirm that you are authorised to use the payment method.

  1. SHIPPING & DELIVERY

5.1 Shipping

We ship to addresses within Australia and internationally. Shipping costs and estimated delivery times are calculated at checkout and vary based on your location, the size and weight of your order, and the shipping method selected.

5.2 Delivery Times

Delivery timeframes provided at checkout are estimates only and are not guaranteed. Once your order leaves our warehouse, delivery is in the hands of our shipping partners (and occasionally the weather gods).

We are not liable for delays caused by:

  • Shipping carrier delays
  • Customs processing (for international orders)
  • Incorrect or incomplete delivery information provided by you
  • Force majeure events (see Section 11)

5.3 Risk of Loss

For Australian customers, risk of loss or damage passes to you upon delivery to the address you provided.

For international customers, risk of loss or damage passes to you when the goods are handed to the international carrier at the point of export from Australia, unless otherwise required by the laws of your jurisdiction.

5.4 Delivery Issues

If your order arrives damaged, is missing items, or doesn't arrive at all, please contact us as soon as possible. We'll work with you and our shipping provider to sort it out. Life's too short for delivery dramas when there's camping to be done.

  1. RETURNS & REFUNDS

6.1 Australian Consumer Guarantees

If you're an Australian customer, our goods come with guarantees that cannot be excluded under the Australian Consumer Law(Schedule 2 of the Competition and Consumer Act 2010 (Cth)). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms limits, excludes, or modifies your rights under Australian Consumer Law.

6.2 Faulty, Damaged, or Incorrect Items

If you receive a product that is faulty, damaged, or not what you ordered, please contact us within 10 days. We may arrange for a replacement, repair, or refund (including any reasonable shipping costs you incur to return the item to us) — depending on the nature and severity of the issue.

For Australian customers, this is in addition to your rights under the Australian Consumer Guarantees.

6.3 When We Don't Offer Returns

We are not obligated to provide a refund or exchange where:

  • You have simply changed your mind about a purchase
  • You found the product cheaper elsewhere
  • You decided you no longer need or want the item
  • The product has been misused, abused, or damaged through neglect
  • The product has been altered or modified

6.4 International Returns for Faulty Goods

International customers returning faulty or incorrect goods are responsible for return shipping costs upfront. We recommend using a trackable shipping method — we can't process a refund for items that don't make it back to us.

6.5 How to Initiate a Return

To start a return, contact us via our website at http://www.seasonfort.com/au. Please include:

  • Your order number
  • The item(s) you'd like to return
  • A description of the issue (photos are really helpful)

We'll assess your claim and provide you with return instructions. Please don't send items back without contacting us first.

6.6 Refund Processing

Once we receive and inspect a returned item, we'll notify you of the outcome. Approved refunds will be processed to your original payment method. Please allow up to 21 business days for the refund to appear in your account.

  1. WARRANTIES

7.1 Manufacturer's Warranty

SEASONFORT products are built for adventure, but they're not indestructible. We warrant our products against defects in materials and workmanship under normal use for a period of 12 months from the date of purchase, unless otherwise stated on the product page.

This warranty does not cover:

  • Normal wear and tear
  • Damage caused by misuse, abuse, neglect, or improper care
  • Damage resulting from modifications or unauthorised repairs
  • Damage caused by exposure to conditions outside the product's intended use (if you use a tent as a sail, that's on you)
  • Cosmetic damage that does not affect functionality

7.2 Warranty Claims

To make a warranty claim, contact us with your proof of purchase and a description (photos help!) of the issue. We'll assess the claim and, if approved, offer a repair, replacement, or refund at our discretion.

7.3 Australian Consumer Law

For Australian customers, this warranty is in addition to — and does not replace, limit, or exclude — any rights and remedies you have under the Australian Consumer Law.

7.4 Limitation for International Customers

For international customers, to the maximum extent permitted by the laws of your jurisdiction, our liability under this warranty is limited to the replacement or repair of the product, or a refund of the purchase price. We do not accept liability for any indirect, incidental, special, or consequential damages.

  1. INTELLECTUAL PROPERTY

8.1 Our Content

All content on the SEASONFORT website — including text, images, graphics, logos, product designs, videos, and software — is owned by or licensed to Safely Pty Ltd and is protected by Australian and international intellectual property laws.

You may not reproduce, distribute, modify, display, or create derivative works from any of our content without our prior written consent. Personal, non-commercial use (like showing your mates our awesome gear) is fine.

8.2 Your Content

If you submit any content to us — such as reviews, photos, or feedback — you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify, and display that content in connection with our business (including marketing and social media). You confirm that any content you submit is your own and doesn't infringe anyone else's rights.

8.3 Trademarks

SEASONFORT, the SEASONFORT logo, and related marks are trademarks of Safely Pty Ltd. Use of our trademarks without written permission is not permitted.

  1. PRIVACY

We take your privacy seriously. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is available on our website and forms part of these Terms. Please take the time to read it.

In short: we collect what we need to process your orders and improve your experience, we don't sell your data, and we comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

  1. LIMITATION OF LIABILITY

10.1 Australian Customers

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law, or any other legislation that cannot be excluded, restricted, or modified by agreement.

Subject to those non-excludable rights, our maximum aggregate liability to you for any claim arising out of or in connection with these Terms, our website, or our products is limited to the total amount you paid us for the relevant product(s).

10.2 International Customers

To the fullest extent permitted by the laws of your jurisdiction:

  • We provide our website and products "as is" and make no warranties, express or implied, beyond those expressly stated in these Terms
  • We exclude all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses arising from your use of our website or products
  • Our maximum aggregate liability to you for any claim is limited to the total amount you paid us for the relevant product(s)

10.3 General Exclusions

We are not liable for:

  • Loss or damage arising from your failure to follow product instructions or care guidelines
  • Loss or damage caused by factors outside our reasonable control
  • Any third-party products, services, or websites linked from our website
  1. FORCE MAJEURE

We're not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, war, terrorism, government actions, supply chain disruptions, power failures, internet outages, or — let's be honest — really wild weather.

We'll do our best to let you know if something like this affects your order and resume normal service as soon as we can.

  1. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Safely Pty Ltd, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms
  • Your use of our website or products
  • Your violation of any law or the rights of any third party
  1. THIRD-PARTY LINKS

Our website may contain links to third-party websites (like our payment providers, shipping trackers, or the occasional inspiring adventure blog). These links are provided for your convenience only. We don't control those websites and aren't responsible for their content, privacy practices, or terms. Visit them at your own discretion.

  1. GOVERNING LAW & DISPUTE RESOLUTION

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia.

14.2 Jurisdiction

Any disputes arising out of or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of Queensland, Australia. For international customers, this means you agree that proceedings may be brought in Queensland courts, though this does not prevent you from bringing proceedings in your own jurisdiction where required by mandatory local law.

14.3 Informal Resolution

Before resorting to formal proceedings, we'd love the chance to sort things out directly. If you have a dispute, please contact us first — most issues can be resolved with a friendly conversation (or email). Camping people are good people, after all.

  1. MODIFICATIONS TO THESE TERMS

We may update these Terms from time to time to reflect changes in our business, the law, or best practice. When we do, we'll update the "Effective" date at the top.

Your continued use of our website or placement of orders after changes are posted constitutes your acceptance of the updated Terms. We encourage you to check back periodically — think of it like checking your gear before a trip.

  1. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect. Think of it like a broken tent pole — you replace the one bit and the rest still holds up.

  1. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Safely Pty Ltd regarding your use of the SEASONFORT website and your purchases from us. They supersede all prior agreements, communications, and understandings, whether written or oral.

  1. WAIVER

Our failure to enforce any right or provision of these Terms at any time does not constitute a waiver of that right or provision. A waiver of any term is only effective if it's in writing and signed by us. Just because we let something slide once doesn't mean we'll let it slide again (a bit like leaving food out at camp — eventually, something will come for it).

  1. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
