Thanks for choosing SEASONFORT — where we believe the best nights are spent under the stars (in seriously good gear). These Terms & Conditions ("Terms") govern your use of our United States website at www.seasonfort.com/us and any purchases you make through it. By browsing, clicking, or buying, you're agreeing to play by these rules.
So grab a camp chair, crack open something cold, and have a read.
- WHO WE ARE
We're Safely Pty Ltd (ABN: 13 150 947 827), a company registered in Queensland, Australia, trading as SEASONFORT. We design and sell outdoor gear to adventurers around the world, including right here in the USA.
Important: SEASONFORT does not have a registered corporate entity in the United States. However, we operate a warehouse in New Jersey, USA, from which all US orders are fulfilled and shipped. Your contractual relationship is with Safely Pty Ltd, an Australian company.
Registered jurisdiction: Queensland, Australia. US warehouse location: New Jersey, USA.
- USING OUR WEBSITE
2.1 Eligibility
You must be at least 18 years of age (or the age of legal majority in your state) to make a purchase. If you're younger than that, get a parent or guardian to place the order for you — call it pre-trip planning practice.
2.2 Your Account
If you create an account with us, you're responsible for:
- Keeping your login details secure (treat them like your best fire starter — don't let them fall into the wrong hands)
- All activity that occurs under your account
- Letting us know immediately if you suspect unauthorised access
We reserve the right to suspend or terminate any account that we reasonably believe is being misused.
2.3 Acceptable Use
When using our website, you agree not to:
- Use it for any unlawful purpose
- Attempt to gain unauthorised access to our systems or data
- Introduce viruses, malware, or other harmful code
- Scrape, data-mine, or reproduce our content without written permission
- Interfere with the website's functionality or other users' enjoyment of it
Basically: leave the campsite better than you found it.
- PRODUCTS & DESCRIPTIONS
3.1 Product Information
We do our best to ensure all product descriptions, images, specifications, and pricing on our website are accurate and up to date. However, we're human (and sometimes we're writing product descriptions from inside a tent in the Australian outback), so we don't warrant that every detail is error-free.
Colours may appear differently on your screen compared to the real thing. Product dimensions and weights are provided in both metric and imperial where possible, but if in doubt, reach out — we're happy to help.
3.2 Availability
All products are subject to availability. We reserve the right to limit quantities, discontinue products, or modify specifications at any time without prior notice.
- ORDERS & PRICING
4.1 Placing an Order
When you place an order through our website, you're making an offer to purchase. We'll send you an order confirmation email, but this doesn't mean we've accepted your order yet. Acceptance occurs when we dispatch your goods from our New Jersey warehouse and send you a shipping confirmation.
We reserve the right to refuse or cancel any order for any reason, including but not limited to:
- Product unavailability
- Pricing errors
- Suspected fraudulent activity
- Inability to verify your identity or payment information
If we cancel your order after payment has been taken, we'll issue a full refund.
4.2 Pricing & Taxes
All prices displayed on our US website are in US Dollars (USD).
US Sales Tax
SEASONFORT operates a warehouse in New Jersey, which establishes a physical presence nexus in that state. As a result:
New Jersey: Orders delivered to New Jersey addresses will include New Jersey Sales and Use Tax at the applicable rate, calculated and displayed at checkout, unless the product or transaction is exempt under New Jersey law.
Other US States: SEASONFORT's US sales volume is currently below the economic nexus thresholds established by other states (generally $100,000 in sales revenue and/or 200 transactions per year in a given state, as established following the US Supreme Court decision in South Dakota v. Wayfair, Inc., 585 U.S. 162 (2018)). As a result, SEASONFORT does not currently collect sales taxon orders delivered to states other than New Jersey.
This may change. We monitor our sales activity and applicable tax laws on an ongoing basis. If our sales in any state reach the applicable economic nexus threshold, or if the law otherwise requires us to collect tax in additional states, we will begin collecting the applicable sales tax in that state. Any such tax will always be clearly calculated and displayed at checkout before you confirm your purchase.
Where taxes are displayed at checkout, the total price you pay is inclusive of those applicable taxes.
Your Responsibility for Use Tax
In states where SEASONFORT does not collect sales tax (i.e., all states other than New Jersey, at the time of this policy), you may have an obligation under your state's law to self-report and remit use tax on your purchase directly to your state's tax authority. Use tax generally applies to purchases made from out-of-state sellers where sales tax was not collected at the point of sale.
SEASONFORT does not provide tax advice. We encourage you to consult your state's Department of Revenue or a qualified tax professional for guidance on your individual use tax obligations.
4.3 No Customs Duties on US Orders
Because all orders are shipped domestically from our New Jersey warehouse, your purchase is a domestic transaction for customs purposes. You will not be charged US Customs duties, import tariffs, or brokerage fees on orders delivered to US addresses.
4.4 Pricing Errors
We work hard to get our pricing right, but if we discover a genuine pricing error before dispatching your order, we'll contact you to let you know. You'll have the option to proceed at the correct price or cancel for a full refund. We are not obligated to fulfil orders at an incorrect price.
4.5 Payment
We accept payments processed securely through eWay and PayPal. All payment card details are handled by these third-party providers — we never store your card information on our servers.
Payment must be received in full before we dispatch your order. By providing payment details, you confirm that you are authorised to use the payment method. All transactions are processed in USD.

Note: If we begin collecting sales tax in your state due to reaching the applicable economic nexus threshold, the tax will be calculated and displayed at checkout before you complete your purchase.
- SHIPPING & DELIVERY
5.1 Domestic US Shipping
All orders placed through our US website are shipped from our warehouse in New Jersey, USA. This means domestic shipping speeds, domestic carriers, and no international customs processing.
Shipping costs and estimated delivery times are calculated at checkout and vary based on your delivery address, the size and weight of your order, and the shipping method selected.
5.2 Shipping Destinations
We currently ship to addresses within the contiguous United States (lower 48 states). Shipping to Alaska, Hawaii, US territories(including Puerto Rico, Guam, US Virgin Islands, and American Samoa), APO/FPO/DPO military addresses, and PO Boxes may be available for select products and shipping methods — availability and any additional charges will be indicated at checkout.
5.3 Delivery Times
Delivery timeframes provided at checkout are estimates only and are not guaranteed. Once your order leaves our New Jersey warehouse, delivery is in the hands of our shipping partners.
We are not liable for delays caused by:
- Shipping carrier delays
- Incorrect or incomplete delivery information provided by you
- Severe weather or natural disasters
- Force majeure events (see Section 11)
- Federal or state holidays
5.4 Risk of Loss & Title
Risk of loss and title to the products passes to you upon delivery to the shipping address you provided (or upon the first attempted delivery, if you are unavailable to receive the shipment).
We recommend selecting a shipping option that includes tracking. If a package shows as delivered by the carrier but you have not received it, please contact us and we will work with the carrier to investigate — though our ability to provide a remedy in such cases may be limited once the carrier confirms delivery.
5.5 Delivery Issues
If your order arrives damaged, is missing items, or doesn't arrive at all, please contact us as soon as possible — ideally within 7 days of the estimated delivery date. We'll work with you and our shipping provider to investigate and find a resolution. The sooner you let us know, the better our chances of sorting it out quickly — kind of like patching a tent before the rain really sets in.
5.6 Undeliverable Orders
If your order is returned to our New Jersey warehouse because it could not be delivered (due to an incorrect address, failure to collect, refusal of delivery, or similar reasons), we will contact you. You'll be responsible for any additional shipping costs to re-send the order. Alternatively, we can issue a refund for the product cost, minus the original shipping charges and any return shipping costs incurred.
- RETURNS & REFUNDS
6.1 Faulty, Damaged, or Incorrect Items
If you receive a product that is faulty, damaged, or not what you ordered, please contact us within 10 days of delivery. We'll work with you to arrange a resolution, which may include:
- A replacement product (subject to availability)
- A repair (where practical)
- A refund to your original payment method
We will assess each claim on a case-by-case basis. We may ask you to provide photos or other evidence of the issue to help us investigate.
6.2 When We Don't Offer Returns
We are not obligated to provide a refund or exchange where:
- You have simply changed your mind about a purchase
- You found the product cheaper elsewhere
- You decided you no longer need or want the item
- The product has been used in a manner inconsistent with its intended purpose
- The product has been misused, abused, or damaged through neglect
- The product has been altered or modified
- The product was damaged due to failure to follow care and use instructions
6.3 Return Shipping
Here's how return shipping works:
- Faulty or incorrect items: Contact us before returning anything and we will give you an address.
- You are responsible for return shipping costs. We recommend using a trackable shipping method. We cannot process a refund or replacement for items that don't make it back to us.
6.4 How to Initiate a Return
To start a return, contact us via our website at http://www.seasonfort.com/us. Please include:
- Your order number
- The item(s) you'd like to return
- A description of the issue (photos are really helpful)
We'll assess your claim and provide you with return instructions and, where applicable, a return shipping label. Please don't send items back without contacting us first — items sent without authorisation may not be accepted or refunded.
6.5 Refund Processing
Once our New Jersey warehouse receives and inspects a returned item, we'll notify you of the outcome. Approved refunds will be processed to your original payment method in USD. Please allow up to 21 business days for the refund to appear in your account, depending on your payment provider.
Refunds will include the product price and any applicable sales tax that was collected at checkout on the returned item(s). Original shipping costs are non-refundable unless the return is due to our error (e.g., we sent the wrong item or a faulty product).
- WARRANTIES
7.1 Manufacturer's Warranty
SEASONFORT products are built for adventure, but they're not indestructible. We warrant our products against defects in materials and workmanship under normal use for a period of 12 months from the date of purchase, unless otherwise stated on the product page.
This warranty does not cover:
- Normal wear and tear
- Damage caused by misuse, abuse, neglect, or improper care
- Damage resulting from modifications or unauthorised repairs
- Damage caused by exposure to conditions outside the product's intended use (if you use a tent as a hang glider, we respect the creativity, but that's on you)
- Cosmetic damage that does not affect functionality
7.2 Warranty Claims
To make a warranty claim, contact us with your proof of purchase and a description of the issue (photos help!). We'll assess the claim and, if approved, offer a repair, replacement, or refund at our discretion.
Warranty returns are shipped to our New Jersey warehouse — please contact us before sending anything back so we can provide instructions.
7.3 Warranty Limitations
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY PROVIDED BY SEASONFORT. WE EXPRESSLY DISCLAIM ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Our total liability under this warranty shall not exceed the original purchase price of the product. We are not liable for any indirect, incidental, special, consequential, or punitive damages of any kind.
7.4 State Law Rights
Some US states do not allow limitations on implied warranties or exclusion of certain damages. If these laws apply to you, some or all of the above limitations may not apply, and you may have additional rights. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
- INTELLECTUAL PROPERTY
8.1 Our Content
All content on the SEASONFORT website — including text, images, graphics, logos, product designs, videos, and software — is owned by or licensed to Safely Pty Ltd and is protected by Australian and international intellectual property laws, including US copyright and trademark law.
You may not reproduce, distribute, modify, display, or create derivative works from any of our content without our prior written consent. Personal, non-commercial use (like showing your trail buddies our awesome gear) is fine.
8.2 Your Content
If you submit any content to us — such as reviews, photos, or feedback — you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify, and display that content in connection with our business (including marketing and social media). You confirm that any content you submit is your own and doesn't infringe anyone else's rights.
8.3 Trademarks
SEASONFORT, the SEASONFORT logo, and related marks are trademarks of Safely Pty Ltd. Use of our trademarks without written permission is not permitted.
8.4 DMCA Notice
If you believe that content on our website infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) by contacting us via our website at http://www.seasonfort.com/us with the following information:
- A description of the copyrighted work you claim has been infringed
- A description of where the infringing material is located on our website
- Your contact information (name, address, email, phone number)
- A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf
- Your physical or electronic signature
We will respond to valid DMCA notices in accordance with applicable law.
- PRIVACY
We take your privacy seriously. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is available on our website and forms part of these Terms. Please take the time to read it.
9.1 US-Specific Privacy Considerations
Because SEASONFORT is an Australian company, your personal information may be transferred to, and processed in, Australia in accordance with Australian privacy law (the Privacy Act 1988 (Cth) and the Australian Privacy Principles). Some of your information is also processed within the United States in connection with order fulfilment, shipping, and payment processing.
By using our website and placing orders, you consent to the transfer of your personal information to Australia for processing where applicable. Australian privacy laws may differ from those in your US state of residence.
If you are a resident of California, you may have additional rights under the California Consumer Privacy Act (CCPA) or the California Privacy Rights Act (CPRA). Please refer to our Privacy Policy for details on how we handle California resident data.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
- OUR WEBSITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
- WE EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
- WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10.2 Limitation of Damages
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAFELY PTY LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE OUR WEBSITE OR PRODUCTS
- ANY DAMAGES ARISING FROM UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR DATA
- ANY DAMAGES ARISING FROM THE CONDUCT OF ANY THIRD PARTY ON OR RELATED TO OUR WEBSITE
REGARDLESS OF THE THEORY OF LIABILITY (WHETHER CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.3 Cap on Liability
OUR MAXIMUM AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, OUR WEBSITE, OR OUR PRODUCTS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT(S) GIVING RISE TO THE CLAIM.

Some US states do not allow the exclusion or limitation of certain damages. If you reside in such a state, the above limitations may not fully apply to you, and you may have additional rights under your state's laws. In such cases, our liability will be limited to the greatest extent permitted by applicable law.
10.5 General Exclusions
We are not liable for:
- Loss or damage arising from your failure to follow product instructions or care guidelines
- Loss or damage caused by factors outside our reasonable control
- Any third-party products, services, or websites linked from our website
- FORCE MAJEURE
We're not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, war, terrorism, government actions or trade restrictions, supply chain disruptions, shipping carrier failures, power failures, internet outages, or — let's be honest — really wild weather.
We'll do our best to let you know if something like this affects your order and resume normal service as soon as we can.
- INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Safely Pty Ltd, its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your breach of these Terms
- Your use of our website or products
- Your violation of any applicable law or regulation
- Your violation of the rights of any third party
- THIRD-PARTY LINKS
Our website may contain links to third-party websites (like our payment providers, shipping trackers, or the occasional inspiring adventure blog). These links are provided for your convenience only. We don't control those websites and aren't responsible for their content, privacy practices, or terms. Visit them at your own discretion.
- GOVERNING LAW & DISPUTE RESOLUTION
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of Queensland, Australia, without regard to conflict of law principles.
14.2 Jurisdiction
Any disputes arising out of or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of Queensland, Australia. By using our website and purchasing products from us, you consent to the personal jurisdiction of the courts of Queensland, Australia for the purpose of resolving any such disputes.
This does not prevent you from bringing proceedings in your own jurisdiction where required by mandatory US federal or state law, and it does not waive any rights you may have to bring claims in a US court if applicable law so requires.
14.3 US Jurisdiction Acknowledgement
You acknowledge that SEASONFORT operates a warehouse in New Jersey and conducts business activity within the United States. Notwithstanding Section 14.1, to the extent that any mandatory US federal or state law (including New Jersey state law) applies to your transaction by virtue of our physical presence or business activity in the United States, such laws shall apply to the extent required and cannot be excluded by these Terms.
14.4 Informal Resolution
Before resorting to formal proceedings, we'd love the chance to sort things out directly. If you have a dispute, please contact us first — most issues can be resolved over email without anyone needing to involve lawyers or fly across the Pacific. Outdoor people are good people, after all.
14.5 No Class Actions
To the fullest extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this provision is found to be unenforceable in your jurisdiction, then this Section 14.5 shall be severed and the remainder of Section 14 shall remain in full effect.
- NEW JERSEY CONSUMER PROTECTIONS
Because SEASONFORT operates a warehouse in New Jersey, the following disclosures are provided in accordance with New Jersey law, including the New Jersey Consumer Fraud Act (N.J.S.A. 56:8-1 et seq.) and related regulations:
- All prices are displayed in US Dollars. Orders delivered to New Jersey addresses include applicable New Jersey Sales and Use Tax, as displayed at checkout.
- Product descriptions and advertising on our website are intended to be truthful, accurate, and not misleading. If you believe any product listing is deceptive or misleading, please contact us immediately.
- Nothing in these Terms is intended to limit or waive any rights you have under the New Jersey Consumer Fraud Act or other applicable New Jersey consumer protection statutes.
- New Jersey residents may also contact the New Jersey Division of Consumer Affairs at www.njconsumeraffairs.gov for information about their consumer rights.
- MODIFICATIONS TO THESE TERMS
We may update these Terms from time to time to reflect changes in our business, the law, or best practice. When we do, we'll update the "Effective" date at the top.
Your continued use of our website or placement of orders after changes are posted constitutes your acceptance of the updated Terms. We encourage you to check back periodically — think of it like checking your gear before a trip.
- SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed or modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect. Think of it like a broken tent pole — you replace the one bit and the rest still holds up.
- ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Safely Pty Ltd regarding your use of the SEASONFORT US website and your purchases from us. They supersede all prior agreements, communications, and understandings, whether written or oral.
- WAIVER
Our failure to enforce any right or provision of these Terms at any time does not constitute a waiver of that right or provision. A waiver of any term is only effective if it's in writing and signed by us. Just because we let something slide once doesn't mean we'll let it slide again (a bit like leaving your cooler open at Yellowstone — eventually, something's going to help itself).
- ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
